Referral Agreement

 

This Agreement is made and effective the [______day, of ___________, 2007 by and between David Kalloo (Finder) and ______________________ (“Seller/Agent”). Seller/Agent is the owner or listing Agent of  ______________________________________________________(real property physical address).

Your acknowledgement on this page, certifies that you have read, understood, and comply with all the terms in this agreement. 

 

You agree not to engage in any illegal business dealings as well as not compete with David Kalloo on information you receive from him including but not limited to any NAMES OF PROSPECTIVE BUYERS(S) or AGENT(s) or CLIENT(S). These contacts given to you by David Kalloo are a project of David Kalloo, you the Seller will not conduct outside business dealings with any name(s) of person(s) given to you by David Kalloo.  

LEADS:. Under this agreement,  David Kalloo is only providing leads. David Kalloo is not acting as a realator noe performing any functions thereof.

Additional Contacts/Leads: Finder may refer to Seller other clients and contacts name and phone numbers via e-mail. Sellers/Agents e-mail address is _________________________________.

REFERAL FEE This is a processing fee  for services rendered in this transaction.  Seller/Agent will pay fee to David Kalloo upon close of escrow only.

  The fee paid to David Kalloo shall be 2% of the total purchase price of the real property  if David Kalloo recommends a buyer who closes escrow on the above stated real property.

Documents To Be Placed In Escrow:  This Agreement shall be placed into escrow when escrow is opened.  Fee will ONLY be paid out through escrow to David Kalloo at COE via wiring instructions or payment instructions given by David Kalloo.

NO ASSIGNMENT: This agreement is not assignable.

Enforcement and severability: In the event that any portion of this agreement is unenforceable by law, the remaining portion shall remain intact. This agreement shall be governed by the laws of the state of California, county of Riverside.

 NOT A REAL ESTATE AGENT:  It is understood that David Kalloo is absolutely not a licensed real estate agent either is he acting as a licensed real estate agent

RIGHT TO LEGAL COUNSEL:  Seller/Agent understands the importance of consulting legal counsel to review the particulars of this agreement before signing it.
